THE HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.No.20570 of 2015 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
"To issue a writ, or order or orders or direction one in the nature of writ of Mandamus, declaring the action of Respondents is illegal, arbitrary and violation of Fundamental Rights (Freedom and Liberty) without jurisdiction and direct the Respondents not to force the petitioner to purchase any land near to capital city of A.P. State of satisfy the respondent No.6 and not to harass the petitioner to register any case with reasonable prima-facie reasons and to provide affection to the life of petitioner and from arrest".
2. Heard Sri D.Kanaka Sundar, learned counsel for the petitioners and learned Government Pleader for Home, appearing for respondents 1 to 5, apart from perusing the material available on record.
3. Today, when the matter is called, written instructions dated 10.7.2015 furnished by the Assistant Sub-Inspector of Police, Chellapally Police Station, Krishna district have been placed on record by the learned Government Pleader for Home. In the said written instructions, it is stated as under:
"The facts of the case are that on 17.5.2015 and 28.6.2015 the 6th respondent herein Ravella Keerthi lodged complaints with the Station House Officer, Chellapally Police Station, Krishna district, stating that her marriage was performed on 4.12.2013 with the petitioner herein and after the marriage her husband/petitioner and family members were harassed physically and mentally for additional dowry. The complainant requested the police to take necessary action.
Basing on the said complaint, this respondent entered the same in the reception counter vide Rc.No.423 dated 17.5.2015. Basing on the said complaint, the respondent police called both the parties for the purpose of counselling.
The complainant's husband/petitioner herein came to the counselling.
The complainants are enclosed herewith for kind perusal of this Hon'ble
Court.
As per the contents of the affidavit the petitioner herein filed divorce O.P.No.732/2015 on the file of the Hon'ble Family Court Judge, City Civil Court, Hyderabad and the same is pending. The contention of the petitioner that the respondents police harassed, threatened and forced the petitioner to sell his ancestral property and purchase the land in the name of the 6th respondent situated near to proposed capital city of newly formed A.P. State or else the petitioner will be implicated in false cases is false, hence denied.
It is submitted that except receiving the said complaints from the 6th respondent herein, the respondents police never interfered with the life the liberty of the petitioner and his family members at any point of time.
It is submitted that earlier the petitioner's mother namely Vijayalaxmi Kumari Kilaru also filed W.P.No.15879/2015 and sought for a directions against the respondents police not to harass her. The W.P.No.15879/2015 is pending.
It is submitted that as stated above the respondents police never harassed, threatened and interfered with the life and liberty of the petitioner and his family members at any point of time. The petitioner instead of cooperating with the counselling filed the present writ petition with baseless allegations".
4. On noticing the same, the learned counsel for the petitioner requested this Court to close the writ petition by recording the said written instructions.
5. In view of the above reasons, the writ petition is disposed of, by recording the written instructions dated 10.7.2015 furnished by the Assistant Sub-Inspector of Police, Chellapally Police Station, Krishna district. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
