HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.1758 of 2014 ORDER : (per Hon'ble Sri Justice R.Subhash Reddy) This writ petition is filed by the petitioner challenging the Notices dated 25.09.2013 and 31.12.2013 issued by the respondent-Bank in exercise of the powers under Section 13(2) and 13(4), respectively, of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.
2. During the pendency of the writ petition, a Memo is filed on behalf of the respondent-Bank vide USR.No.11629/2014 stating that the impugned notices are withdrawn. The said Memo is placed on record.
3. In view of the said Memo, this writ petition is dismissed as infructuous. Interim order granted by this Court on 31.01.2014 is vacated. However, it is made clear that if any further cause of action arises, the respondent-Bank is given liberty to initiate fresh proceedings in accordance with law. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
