HON'BLE SRI JUSTICE S.V. BHATT W.P. No.19997 OF 2018 ORDER:

The writ prayer is substantially against inaction of respondents in protecting Government land in an extent of Ac.1-50 cents in Survey No.38 (Ex-servicemen Colony), Gollelapalem Village, Malkapuram, Visakhapatnam Urban, as illegal and arbitrary. On 20th June, 2018, this Court directed respondents to file status report after physically inspecting the land and also conducting survey. The Mandal Revenue Officer places on record the report dated 27.06.2018 of the Mandal Surveyor. The relevant portion of the report reads thus:

"In this connection, I submit that the subject land in Sy.no.38 of Gullalapalem Village, is classified as "Konda Poramboke" and there was Ex-Servicemen colony lay out formed in the year 1983, and the then Revenue Divisional Officer, Visakhapatnam has issued house site pattas vide Proceedings D.Dis.No.5093/183 (B), dt.30-11-83, to the eligible beneficiaries for grant of loan for constructions of their houses.

It is further submitted that out of an extent of Ac.1.50 Cts. in Sy.No.38 of Gullalapalem Village, an extent of Ac.0.50 Cts. was allotted for construction of Temple (Sri Venkateswara Swamy) and Community Hall, and the remaining extent Ac.1.00 Cts was "small hillock" is covered by bushes, and it is under close vigil by the Revenue authorities and it is in possession of the Government."

This Court places on record the report and accepts the same.

Hence, the writ petition is disposed of by directing the respondents to protect the Government land as stated in the inspection and survey report.

No order as to costs.
