HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner competed to the post of Police Constable (Women) in Hyderabad district. Petitioner is a Scheduled Tribe category candidate. According to the petitioner, she secured 82 marks and cut-off mark prescribed was 82. Learned counsel for petitioner contends that having secured cut-off marks, petitioner ought to have been selected and her non-selection is illegal. 2.

Learned Government Pleader, on instructions, submits that two candidates secured 82 marks. The date of birth of other candidate, who secured 82 marks, is noted as 01.10.1992, whereas the date of birth of petitioner is 09.05.1997. When two candidates secure same marks, the candidate who is elder is preferred and in the instant case, as the other candidate being elder to petitioner, the said candidate was preferred.

In view of the same, there is no merit in the contention of the learned counsel for petitioner. It cannot be said that petitioner was illegally ignored. The writ petition is liable to be dismissed and is accordingly dismissed. However, as fairly submitted by the learned counsel for petitioner, it is needless to observe that in case there is revision in the merit list or increase of vacancies, where under if there is possibility of reducing the eligibility cut-off mark, the claim of the petitioner shall also be considered.
