HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.22744 OF 2019 ORDER:
With the consent of both parties, the Writ Petition is taken up for disposal at the stage of admission itself.

Learned counsel for the petitioner as well as learned counsel for the respondents informed this Court that the issue raised in this writ petition is squarely covered by a decision of this Court in W.P. No.21342 of 2019 and batch dated 26.09.2019 and in terms thereof, the present Writ Petition can also be disposed of. 3.
In view of the above said submission, following the aforesaid decision, this writ petition is disposed of directing the respondents to continue to pay higher pension as already determined to the petitioner and if any recovery is already effected, that amount shall immediately be credited to the account of the petitioner. However, it is open for the EPF authorities to take further steps as warranted by law by issuing a show cause notice giving all details required by the petitioner so as to enable him to submit his explanation and thereafter it is always open for the respondents to pass appropriate orders in accordance with law.
4. With the above observations, the Writ Petition is disposed of. No order as to costs.
Miscellaneous Petitions, if any pending, in the writ petition shall stand closed.
