Respondent/Complainant COUNSEL FOR THE PETITIONERS: Sri Naga Praveen Vankayalapati COUNSEL FOR THE RESPONDENT : The Additional Public Prosecutor Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and grounds filed herein, the High Court may be pleased to release the petitioners on bail in the event of the petitioners arrest in connection with Crime no. 77 of 2013 o f Chinaganjam Police Station, Chinaganjam Mandal, Prakasam District.

ORDER:

This criminal petition is filed by the petitioners-A23, A38 and A54 under Section 438 of the Criminal Procedure Code seeking anticipatory bail in Crime No.77 of 2013 of Chinaganjam Police Station, Prakasam District, registered for the offence punishable under Sections 143, 147, 342, 353, 506, 509 and 149 of IPC and Sec.7 of CLA Act, 1932 and Sections 220 and 221 of A.P.Panchayat Raj Act, 1994.

2. Heard the learned counsel appearing for the petitioners - A23, A38 and A54 and the learned Additional Public Prosecutor representing the respondent-state.

3. The incident arose during the recent panchayat elections. No specific overt acts have been attributed to the petitioners. Learned counsel appearing for the petitioners submits that due to village politics, the petitioners are involved in the present case. Having regard to the nature of allegations made in the FIR, I am inclined to grant anticipatory bail to the petitioners - A23, A38 and A54.

4. In the result, the Criminal Petition is allowed and the petitioners-A23, A38 and A54 are therefore directed to surrender before the Station House Officer, Chinaganjam Police Station, Prakasam District, within twenty days from today and thereafter, they

shall be released on bail on their executing personal bonds for a sum of Rs.10,000/-(Rupees ten thousand only) each with two sureties for the like sum each to the satisfaction of the said SHO. ASSISTANT REGISTRAR //TRUE COPY// for ASSISTANT REGISTRAR To 1.
