THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.14332 of 2013 ORDER:
This writ petition was filed challenging the order in I.A.No.8/2011 in R.P. No.1/1011 in O.P. No.23/2005 dated 23.04.2013.
This Court by order dated 15.05.2013, while issuing notice before admission, granted stay of the said order subject to the condition of the second respondent furnishing security in the nature of bank guarantee for Rs.28 crores within two weeks. This writ petition was filed by the Transmission Corporation of Andhra Pradesh Limited, and others.
At the time of taking up the vacate petition, the learned counsel appearing for the petitioners is absent. However, it is submitted by the learned counsel for the second respondent that subsequent to passing of the said order dated 15.05.2013, the review petition viz., R.P. No.1/2011 itself was disposed of and the said order was challenged before the Hon'ble Supreme Court of India and by virtue of the orders passed in Civil Appeal No.4463/2015 the present writ petition has become infructuous.
In view of the submission made by the learned counsel for the second respondent, this Writ Petition is dismissed as infructuous. There shall be no order as to costs. In the circumstances, the second respondent shall be bound by the orders passed by the Hon'ble Supreme Court of India in Civil Appeal No.4463/2015 and not by the order of this Court dated 15.05.2013. The bank guarantee, if any, furnished as per the direction of this Court dated 15.05.2013, need not be renewed if there is no order to that effect by the Hon'ble Supreme Court of India.
Miscellaneous Petitions, if any, pending in this writ petition
shall stand closed.
