This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction on the part of the respondent Nos.2 and 3 in providing domestic electricity connection to the shed of the petitioner as illegal and arbitrary.
Heard the learned counsel for the petitioner and Sri R. Vinod Reddy learned standing counsel for TRANSCO (Telangana), representing the respondent Nos.1 to 3.
it is the case of the petitioner that she is having agricultural land in Sy.No.136 and 137 of Mulkalla village, Mancherial Mandal, Adilabad District. She constructed a shed in her agricultural land in order to store agricultural products. The petitioner submitted an application on 02.04.2016 to the third respondent with a request to provide new electricity service connection to her shed. On 13.06.2016, the petitioner had obtained NOC from the Mandal Praja Parishad Officer, Mancherial in respect of the land in question. At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the respondent No.3 to consider the application submitted by the petitioner on 02.04.2016 and pass appropriate orders. The learned standing counsel also consented for the same.
In view of the submissions made by both counsel, this Court is not inclined to go into the merits of the main case.
Having regard to the facts and circumstances of the case and also the submissions made by both counsel, the third respondent is hereby directed to consider the application of the petitioner dated 02.04.2016 for providing new electricity service connection to the shed of the petitioner and dispose of the same in the light of the provisions of the Electricity Act, 2003 and Rules made there under, as expeditiously as possible, preferably, within one month from the date of receipt of a copy of this order. With the above direction, this Writ Petition is disposed of. No order as to costs.
