ORDER:

This writ petition is filed for a mandamus to declare the action of respondent No.2 in issuing notification in Rc.No.958/2008-G, dated 25.09.2008, as illegal and arbitrary.

At the hearing, the learned Assistant Government Pleader for Civil Supplies (AP) submitted that after the filing of this writ petition, a fresh notification was issued and a third party was appointed as the permanent fair price shop dealer of Pulladigunta Village, Vatticherukuri Mandal, Guntur District. The learned counsel for the petitioner has also submitted that in view of the said subsequent event, the cause in the writ petition has become infructuous. In the light of the above facts, the Writ Petition is dismissed as infructuous. As a sequel to dismissal of the writ petition, interim order dated 16.10.2008 in W.P.M.P.No.29337 of 2008 is vacated and W.P.M.P.No.29337 of 2008 filed by the petitioner for interim relief shall stand dismissed as infructuous.
