HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35485 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the respondents 3 to 8 in interfering with the personal life and liberty of the petitioner, without there being any case against him, as illegal and arbitrary and consequently, direct the respondents 3 to 8 not to interfere with the personal life and liberty of the petitioner.

Heard and perused the material available on record. The petitioner is a business person and also running a bus service and he never involved in any criminal case nor he has any criminal background. Whiles, suddenly, the police came to the house of the petitioner in his absence and stated to his parents to tell him to surrender before the police. The grievance of the petitioner is that the police are frequently coming to his house and threatening his parents to ask him to surrender, with an intention to take him into custody, without there being any complaint or crime pending against him and thereby, interfering with the his personal life. Considering the circumstances of the case and also the grievance of the petitioner, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:

The respondent Nos.2 to 8 are directed not to interfere with the personal life and liberty of the petitioner. However, this Order will not stand in the way of the respondent Nos.2 to 8 to register a case, if any complaint is lodged against the petitioner for cognizable offence. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ______________ RAJA ELANGO, J October 21, 2016 KTL
