Heard.

The petitioner questions the action of the respondents in not receiving and entertaining the document presented by him relating to Plot No.37 admeasuring Ac.244.4/9 sq. yards in Sy.No.382 (part) situated at Kallur Village, Mandal and District, on the ground that NOC must be produced by him. The petitioner states that he purchased the said land from M/s.Auto Workers Welfare Association vide registered sale deed bearing document No.2870 of 1995, dated 28-03-1995 and the said land is not a Government land and hence, seeking NOC by the 2nd respondent is not justified. Learned Government Pleader for Revenue has not received instructions in spite of grating time thrice.

In the circumstances, this writ petition is disposed of directing the registering authorities concerned to receive and process the document presented by the petitioner without insisting upon the no objection certificate to be obtained by him. The registering authorities concerned is further directed to receive and process the document in accordance with the Registration Act, 1908 and Indian Stamp Act, 1899 and if the document is in conformity with the provisions, thereafter register and release the document in accordance with the due procedure.

It is also made clear that in the event of registering authority not being satisfied with the compliance under the Registration Act or the Stamp Act, appropriate refusal endorsement together with reasons shall be recorded and communicated to the petitioner in terms of Section 71 of the Registration Act. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed. _______________________ VILAS V.
