THE HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5603 of 2016 ORDER:
This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by petitioner/accused seeking to quash the S.T.C.No.81 of 2016 on the file of the IV Additional Judicial First Class Magistrate, Chittoor, for the offence under Section 138 of Negotiable Instruments Act.
Heard and perused the material available on record. After arguing for sometime, the learned counsel for the petitioner, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioner before the trial Court.
In any event, considering the nature of allegations against the petitioner-accused and the petitioner being a lady, presence of the petitioner-accused before the trial Court is dispensed with except on the dates of framing of charges, examination under Section 313 Cr.P.C. and pronouncement of the judgment.
However, the petitioner-accused shall be properly represented through her counsel before the trial Court.
Accordingly, the Criminal Petition is disposed of. Consequently, the miscellaneous petitions pending in this petition, if any, shall stand closed.
