HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.22802 OF 2019 ORDER:

The relief sought for in the present Writ Petition is to declare the action of the respondent police in not providing protection to the petitioners from the hands of the 4th respondent, as being illegal, arbitrary and against the principles of natural justice and also violative of Articles 14, 19 and 21 of the Constitution of India. A consequential direction is sought to the respondent police to provide protection to the petitioners from the hands of the unofficial respondent and his family members.

The case of the petitioner is that the 1st petitioner is the daughter of the 4th respondent, who entered into wedlock with 2nd petitioner on 05.10.2019 against the wishes of her father i.e., the 4th respondent and is being pressurized and harassed by the 4th respondent to return to the home, failing which threatenings are given that the 2nd petitioner would be killed. That being so, the petitioners approached the 3rd respondent seeking for protection from the hands of the 4th respondent and his family members. Though, the 3rd respondent received the complaint did not extend the police protection. Hence, being aggrieved, the present Writ Petition is filed. Heard Sri G. Ravi Chandra Sekhar, learned Counsel for the petitioners and Sri K. Syam Sunder, learned Counsel

representing R-4 and the Assistant Government Pleader for Home.

Learned Government Pleader for Home, on written instructions dated 21.10.2019, submits that on receiving the complaint from the 4th respondent dated 05.10.2019, the 3rd respondent made a G.D. entry and called the parents of both parties and advised the parents not to interfere with the life and liberty of the 1st petitioner.

Learned Counsel for the 4th respondent would also submit that the 4th respondent had given an undertaking before the 3rd respondent that there would be no interference with the life and liberty of the 1st and 2nd petitioners herein either from himself or by his family members. Having regard to the undertaking given by the 4th respondent before the 3rd respondent authority, no further orders are required to be passed.

Accordingly, the Writ Petition is closed. No order as to costs.

The miscellaneous petitions pending, if any, shall also stand dismissed.
