HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37243 of 2016 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India challenging the action of the 2nd respondent in not registering the crime against respondents Nos.3 and 4 on the complaint lodged by the petitioners on 24.5.2016.

Heard and perused the material available on record. 3.
It is stated in the affidavit that respondents Nos.3 and 4 agreed to sell their property to the petitioners and took advance amount and later, they failed to execute a registered sale deed and failed to return the money to the petitioners and subsequently, the above said respondents filed cases claiming hefty amounts and alleging that they have supplied various paint materials to the 1st petitioner-company, and claiming amount. On verification of the said documents, it is found that the said documents were forged. Then, the petitioners field a complaint before the 2nd respondent. But the said complaint was not registered.

Considering the circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:
"Respondent No.2 is directed to register the complaint of the petitioners dated 24.5.2016, if it discloses any cognizable offence and proceed in accordance with law. If the above said respondent fails to register the complaint, the petitioners are at liberty to avail the remedies that are available under Cr.P.C." There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
