HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15922 of 2004 ORDER:
When the matter is taken up for hearing, it is noticed that the petitioner is seeking to declare the proceedings dated 02.09.2004 as illegal, arbitrary and contrary to the Rules and set aside the same and consequently direct the respondents to continue the petitioner as Assistant Registrar on regular basis with effect from the date of his promotion as Assistant Registrar with all consequential benefits. A perusal of proceedings dated 02.09.2004 discloses that the petitioner was promoted as Assistant Registrar purely on temporary basis vide proceedings dated 03.09.2001 for a period of three years and the period of contractual promotion expired on 02.09.2004. Consequently, the respondents have posted the petitioner in the substantive post as Superintendent. Challenging the same, the present writ petition is filed. A perusal of the record discloses that the petitioner has attained the age of superannuation and no interim directions were granted by this Court. Now that the petitioner has retired from service, the cause in the writ petition may not survive.
In view of above, the writ petition is dismissed as infructuous. No order as to costs.
