Heard learned counsel for petitioner and learned Government Pleader for Revenue.

According to petitioner, petitioner, his mother and sister are joint owners and in possession of land admeasuring Ac.0.15 1⁄2 guntas in Survey No. 63, Nizampet village, Bachupally mandal, Medchal-Malkajgiri district. It appears 4th respondent was trying to claim the said property, aggrieved thereby, O S No. 283 of 2018 on the file of XVI Additional District Judge at Malkajgiri was instituted seeking partition and separate possession and an application was also moved for grant of interim injunction restraining the 4th respondent from alienating the subject property. On 24.9.2018 petitioner made a representation to the Sub Registrar requesting not to entertain any document for registration of land to an extent of Ac.0.15 1⁄2 guntas (wrongly mentioned as Ac.15.5 guntas in representation) in Survey No. 63, Nizampet village, Bachupally mandal, Medchal-Malkajgiri district.

The Sub Registrar vide endorsement dated 19.9.2018 informed the petitioner that copy of the order of status quo, if any granted by trial Court be enclosed. As no status quo order was granted, petitioner could not reply to the Sub Registrar and filed this writ petition seeking direction restraining respondents from entertaining any deed of conveyance for registration for the subject land.

As per the provisions of the Registration Act, 1908 and Rules made thereunder, whenever, a deed of conveyance is presented before the Sub Registrar, he has to entertain, process and if the document is otherwise in order to register or raise objection assigning reasons to

refuse registration. Therefore, Sub Registrar cannot be inducted against refusing deed of conveyance to be presented before him. If petitioner has any grievance against 4th respondent or any other person through him, he has to workout his remedies in the pending suit. Therefore, relief sought in the writ petition cannot be granted. Accordingly, writ petition is dismissed.
