HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No. 1976 OF 2017 ORDER:
This writ petition is filed for the following relief: "... to issue a writ of mandamus or any other appropriate writ or writs, order or direction, declaring the action of first respondent in not releasing the amounts realized by conduct of auction on 29.04.2016 and 30.04.2016 in respect of lands of petitioner institution, as illegal, arbitrary and without jurisdiction and to consequently direct the first respondent to forthwith release the above amounts in favour of petitioner institution."
The grievance of the petitioner obviously is the inaction on the part of the 1st respondent in considering and disposing of the representations, dated 17.05.2016 and 12.09.2016, said to have been filed by it. Sri Mirza Safiulla Baigh, learned Standing counsel for the 2nd respondent, Wakf Board, on instructions, submits that the said representations are pending. As the said representations are pending, learned counsel for the petitioner requests this Court to direct the 1st respondent to consider the same and pass orders within a time frame.
In view of the above submission of the learned counsel for the petitioner, without going into the merits of the case, the writ petition is disposed of directing the 1st respondent to pass appropriate orders on the representations, dated 17.05.2016 and 12.09.2016 said to have been submitted by the petitioner, within a period of four weeks from the date of receipt of a copy of this order. Miscellaneous petitions, if any, shall also stand disposed of. No order as to costs.
