VRS, J & MGR, J WP Nos.18949 &33756 of 2016 HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE M. GANGA RAO WRIT PETITION Nos.18949 AND 33756 OF 2016 COMMON ORDER: (per V. Ramasubramanian, J) Aggrieved by the out of turn promotion given to the reserved category candidates, the petitioner in both the writ petitions, who is working as a Senior Assistant has come up with the above writ petitions.

2. Heard Mr. Syam Sundar Kondapalli, learned counsel for the petitioner and Smt.Bobba Vijayalakshmi and Sri S. Sri Ram, learned Standing Counsel appearing for the respondents.

3. In the second writ petition, the persons who are allegedly juniors to the petitioner and who secured a march over the petitioner have not been made parties. In the first writ petition a private individual, who gained promotion along with the petitioner, despite being a junior, has been impleaded.

4. The out of turn promotion given to the 3rd respondent was on account of the fact that she belonged to the reserved category.

5. The Andhra Pradesh State and Subordinate Service Rules, have been implemented under G.O.Ms.No.123, General Administration, dated 19.04.2003, providing for rule of reservation in the matter of promotions. The Rule is not under challenge. Therefore, the grievances of the petitioner cannot be redressed.

6. Hence, the Writ Petitions are dismissed. As a sequel thereto, miscellaneous petitions, if any, pending shall stand dismissed. No order as to costs.
