THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8178 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused seeking bail in the event of his arrest in connection with Crime No.148 of 2023 on the file of Veenavanka Police Station, Karimnagar District, registered for the offence punishable under Section 324 of Indian Penal Code. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The petitioner is seeking relief of anticipatory bail. The allegation against the petitioner is that he reached the canal and released the water which entered into the complainant's paddy field causing damage to his fields. When questioned, it is alleged that he grew angry and abused the complainant in filthy language and beat him on his head and face.

Learned counsel appearing for the petitioner would submit that initially case was registered under Section 324 of IPC, however, the said Section was altered to Section 326 of IPC. The injured has been treated as outpatient.

On the other hand, learned Additional Public Prosecutor would submit there is no grievous injury and only one simple injury was received by the victim/complainant. 6.

However, keeping in view that altercation ensued on account of releasing water in between neighbouring farmers, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioner subject to the following conditions:

1) The petitioner/Accused is directed to surrender before the Station House Officer, Veenavanka Police Station, Karimnagar, on 06.09.2023. On such surrender, the said Station House Officer shall release the petitioner on bail, on his executing personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioner/Accused shall appear before the concerned Station House Officer at 10.00 A.M everyday till 14.09.2023, for the purpose of investigation and thereafter, as and when required.

3) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
