G. Ravinder, S/o. Late Sri Vasuram, Aged 36 years, Occ: School Assistant Maths, presently working at Mandal Praja Parishad School, Dandapelly Mandal, R/o.1-122/1, Jannaram Mandal, District Mancherial .. Petitioner And The State of Telangana, rep., by Principal Secretary, Education Department, Secretariat Buildings, Hyderabad and others .. Respondents The Court made the following:

THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.20068 OF 2018 ORDER:

Heard.

2.

Petitioner is working as School Assistant (Mathematics) in Telugu Medium in Zilla Parishad Secondary School, Dandepally Mandal, Macherial, w.e.f. 19.07.2015. Spouse of the petitioner is working as School Assistant (English) in Zilla Parishad School, Kalamadugu, Jannaram Mandal, Adilabad District. Consequent upon lifting of ban on transfers and notifying the Telangana Teachers (Regulation of Transfers) Rules, 2018 (for short, 'the Rules') by the Government vide G.O.Ms.No.16, dated 06.06.2018, petitioner claims to have applied for transfer. 3.

According to learned counsel for the petitioner, he is blessed with two children and his mother is old aged and requires personal attention. Therefore, petitioner seeks suitable posting and in the prayer, he sought direction of posting him as School Assistant in Nirmal.

4.

As briefly noted above, wife of the petitioner is working near Jannaram, which, according to learned counsel for the petitioner, is about 80 kilo meters from the present place of posting. Further, the transfer counselling of Teachers is governed by the Rules. The said Rules prescribe detailed procedure, weightage points for service rendered and special points under spouse grounds. 5.

Since the petitioner claims that his wife is working in the same district, petitioner is entitled to additional points on spouse

ground. However, the claim of the petitioner for transfer has to be strictly in accordance with the Rules and therefore no direction to post the petitioner in a particular place can be granted. The Writ Petition merits no consideration.

6.

The Writ Petition is accordingly dismissed. However, it is open to the petitioner to ventilate his grievance, if choice of posting is not granted to him in the transfer counselling. There shall be no costs. Miscellaneous petitions, if any pending, are closed. ____________________ P. NAVEEN RAO, J Date:18.06.2018 Note:- Issue C.C. in one week.
