HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 13059 of 2017 ORDER:

Heard the learned counsel for the petitioner and learned Government Pleader for Transport.

The petitioner challenges vehicle check report dated 11.04.2017 as well as seizure of HMV Goods Carriage bearing No.TS02UB1323 on the ground of overload. As seen from the check report dated 11.04.2017, the petitioner is alleged to have overloaded the vehicle by 18.4 tons over and above the carrying capacity. The said overload is in violation of norms notified under the Motor Vehicles Act. In those circumstances, this Court is not inclined to direct release of HMV Goods Carriage bearing No.TS02UB1323. However, considering the fact that petitioner has already made a representation to respondent No.2 on 11.04.2017 itself, respondent No.2 shall consider, and pass appropriate orders, within a period of one week from today.

The Writ Petition is, accordingly, disposed of. Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
