THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.5451 OF 2017 ORDER:

The order of cancellation of Fair Price Shop dealership of the petitioner passed by the Revenue Divisional Officer, Tekkali, vide proceedings Rc.No.257/2015 CS, dated 29.12.2015, is under challenge in the present writ petition. 2.

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies for the respondents.

The material available before this Court discloses that as against the above said order of cancellation passed by the Revenue Divisional Officer, petitioner herein filed appeal before the Joint Collector (Civil Supplies), Srikakulam - 2nd respondent herein on 27.01.2016 and according to the learned counsel for the petitioner, the same is pending consideration before the 2nd respondent and no orders have been passed. A request is made by the learned counsel for the petitioner to direct the 2nd respondent to pass appropriate orders on the said appeal filed by the petitioner by fixing some timeframe. The same is not opposed by the learned Government Pleader and on the otherhand, it is submitted by the learned Government Pleader that the said appeal will be considered and be disposed of, in accordance with law.

For the aforesaid reasons, this writ petition is disposed of, directing the Joint Collector (Civil Supplies), Srikakulam - 2nd respondent herein to pass appropriate orders on the appeal dated 27.01.2016 preferred by the petitioner herein against the orders of cancellation passed by the Revenue Divisional Officer, vide proceedings Rc.No.257/2015 CS, dated 29.12.2015, within a period of three months from the date of receipt of a copy of this order, after giving opportunity of hearing to the petitioner herein.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
