This Petition is filed seeking transfer of C.C.No. 55 of 2011 on the file of the Court of the X Special Magistrate, Hyderabad to the Court of the XXII Special Magistrate, Hyderabad to be tried along with C.C.No. 294 of 2011 pending on the file of the said Court.

Sri I.V. Radhakrishna Murthy, learned counsel for the petitioners would submit that both the cases i.e. C.C.No. 55 and 294 of 2011 were filed by the 2nd respondent - complainant herein for the offence punishable under Section 138 of the Negotiable Instruments Act.

Since this Petition has not been opposed by the 2nd respondent and since the parties to both the cases are one and the same, it would be more appropriate if both of them are tried together.

Hence, C.C.No. 55 of 2011 on the file of the Court of the X Special Magistrate, Hyderabad is ordered to be transferred to the Court of the XXII Special Magistrate, Hyderabad forthwith to be tried along with C.C.No. 294 of 2011. With this, the Transfer Criminal Petition is allowed.
