THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.5140 of 2012 ORDER:

The action of the 5th respondent in stopping the power supply by proceedings dated 21.02.2012 is questioned in this writ petition as arbitrary and illegal. By way of interim relief, the petitioner sought a direction to the 5th respondent to provide service connection to him ignoring the proceedings dated 21.02.2012.

Interim direction, as prayed for, was granted on condition that the petitioner paid all the necessary charges. Proceedings dated 21.02.2012 was issued by the Additional Assistant Engineer, as the Executive Officer of Sri Sitharama Swamy Devasthanam, Deveryamjal had raised an objection not to release service connection claiming that these lands belong to the Endowments Department, and the matter was subjudice before this Court in W.P.No.20219 of 2011.

As electricity connection has already been granted pursuant to the interim order passed by this Court, suffice it, while disposing of the writ petition, to make it clear that grant of service connection would not confer any right on the petitioner to claim that the subject land belongs to him; and it is always open to the Endowments Department, or the subject temple, to agitate their rights over the subject land in appropriate legal proceedings.

Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
