Cess Sircilla Area Electrical Casual Workers Association v. The State Of Telangana
THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.37049 of 2016 ORDER:
Heard Sri Mohd.Asifuddin for petitioner and Assistant Government Pleader for Co-operation for respondents. The petitioner complains against inaction in taking appropriate decision in terms of Rc.No.36/ 2014-B, dated 13-07-2016 as illegal and amounts to refusing to exercise the jurisdiction conferred on the 4th respondent.
The communication dated 13-07-2016 reads thus :- " From To Sri C.Ambaiah The Managing Director M.A., L.L.B.(M.Phil.) Coop. Elec tric Society Ltd., Dist. Coop. Officer, SIRCILLA.
KARIMNAGAR.
R.C.No.36/ 2014-B, Dated 13-07-2016 Sir, Sub: Election - Conduct of Election to CESS Ltd., Sircilla 2016 - Irregular expenditure on conduct of Election - Allegation levelled - Enquiry ordered called for - Report submitted - Reg.
Ref :-1. This office Memo Rc.No.36/ 2016 B, dated 4-4-2016.
2. Divisional Coop. Officer, Sircilla Endt.Rc.No.301/ 2016-B, dt.6-4-2016.
3. SDLCO, Sircilla Lr.No.Nil, dt.28-6-2016.
*** I invite your personal attention to the subject and references cited (copy enclosed) wherein the SubDivl. Coop. Officer, Sircilla has informed in this report stated that as per the directions of Hon'ble High Court, Hyderabad Sri K.Ramesh Srinivas and Babu were
conformed as casual labours (Court Order copy is enclosed) and also further informed that the services of Satheesh and 5 others as V.E.W. in the CESS area regularize as per the existing norms and as per the decision of Managing Committee as the powers vested with the Managing Committee as per Act and Rules of the Society accordingly."
Counsel for 4th respondent tries to convince this Court that for justifiable reasons, the 4th respondent did not act as directed in the letter dated 13-07-2016 and further contends that there is no inaction.
The objection of 4th respondent cannot be considered at this stage of the matter. Since the grievance is against inaction, this court considers it appropriate to direct the 4th respondent to take a decision on the communication dated 13-07-2016 within four weeks from the date of receipt of a copy of this order. It is needless to observe that the 4th respondent can examine the entire issue, merits of the case and decide objectively.
The writ petition is disposed of accordingly. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed. _____________ S. V. BHATT, J Dt: 31-10-2016 Prv
