HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.24489 of 2017 ORDER:

The petitioners are octogenarians and complain the inaction in disposing of the application dated 03.05.2017.

2. Mr. M. Vidyasagar appearing for petitioners submits that the petitioners may be given liberty to file application in the prescribed form and the 1st respondent may be directed to consider and dispose of the same expeditiously.

3. Normally the petitioners establish demand and refusal and approach, this court canvassing inaction. But in the case on hand, keeping in view the age of the petitioners, this court considers it appropriate to grant liberty to represent to 1st respondent for expeditious decision and further has no reason to doubt that the 1st respondent will not discharge the duty within the time stipulated by the Act. The petitioners are given liberty to send online application by enclosing a copy of this order to the first respondent for consideration and expeditious disposal.

4. The writ petition is accordingly disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
