HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19622 OF 2018 ORDER :

Aggrieved by the action of the 3rd respondent in not investigation into FIR.No.64 of 2018 though a case is registered on 01.04.2018, this Writ Petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for respondents. Learned Assistant Government Pleader for Home, produced written instructions, stating that the basing on the complaint of the petitioner, a case in Crime No.64 of 2018 for the offence under Section 420 IPC was registered and that during the course of investigation by the 3rd respondent, it discloses that the complaint of the petitioner as 'False'. He submits that the 3rd respondent sent the file to the Assistant Commissioner of Police, South Division, Vijayawada City to give permission to refer the case as 'False'. He submits that after serving notice to the petitioner, final report was filed before the III A.C.M.M., Vijayawada on 05.07.2018 vide C.F.No.3042/2018.

In view of the submission of the learned Assistant Government Pleader for Home, this Writ Petition is disposed of. However, it is open for the petitioner to avail alternate remedy available to him under law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
