THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.43329 of 2016 ORDER:

Petitioners complain against seizing Tractors and Trailers bearing Nos.AP 15 TB 7601 and AP 15 TB 7599 and AP 36 R 5986 and AP 36 R 6026 as illegal and unconstitutional and seek release of the vehicles in terms of G.O.Ms.No.3 Industries & Commerce (Mines-I) Department dated 08.01.2015 and G.O.Ms.No.15 Industries and Commerce (Mines-I) Department dated 19.02.2015.

On instructions, the Assistant Government Pleader for Home, submits that the subject vehicles have been deposited before the concerned Magistrate. Since the vehicles are deposited with the Court of competent jurisdiction, the petitioners have to move the Court for appropriate reliefs.

By granting liberty to file application for release of vehicles, the writ petition is disposed of. Policy decision is taken in G.O.Ms.No.3 dated 08.01.2015 and G.O.Ms.No.15 dated 19.02.2015 for release of vehicles. The petitioners are given liberty to bring the policy decision to the notice of the Court, when their application is considered for release of vehicles.
