THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6355 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.1 in Crime No.232 of 2022 on the file of Station House Officer, Jagtial Town Police Station, Jagtial District registered for the offence punishable under Section 489-B and C of Indian Penal Code. 2.

Heard learned counsel for the petitioner/Accused No.1 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that on 05.06.2022 at Jagtial Bus Stand parking area this petitioner who is Accused No.1 and four others were apprehended by Jagtial Town Police and found Rs.15,00,000/- fake currency notes in their possession.

Accordingly, Accused Nos.1 to 5 were arrested and remanded to judicial custody.

Learned counsel for the petitioner/Accused No.1 submits that in this case Accused Nos.2 to 3 were granted regular bail by the Prl.Sessions Judge, Jagitial.

Learned Assistant Public Prosecutor on instructions would submit that as per confession of this petitioner, he was involved in criminal cases earlier during the years 2003, 2005, 2006 and 2012. However, the details are not provided by the learned Assistant Public Prosecutor.

It is not known as to what were the cases this petitioner was involved and the said details of involvement in cases was the confession of this petitioner which was recorded by the police. 7.

In the said circumstances, the petitioner/Accused No.1 can be granted the relief of regular bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.1 is granted bail subject to the following conditions:

i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties

for a like sum each to the satisfaction of I Additional Judicial First Class Magistrate at Jagtial, Jagtial District. ii) The petitioner/Accused No.1 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of three (03) months and thereafter as and when required.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 04.08.2022 ns
