HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.20290 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer of Gaduru Village, V.Kotturu Mandal, Srikakulam District. The authorization of the petitioner was suspended on 26.04.2008 on the ground that 6A proceedings were pending against him. The second respondent issued a letter dated 01.09.2014 to the third respondent directing him to take a decision either to suspend or cancel the authorization of the fair price shops involved in 6A cases. So far, no decision was taken. Hence the Writ Petition. Now the third respondent is competent to take action against the dealers but not the fourth respondent. However, when the fourth respondent passed an order on 26.04.2008, he was having jurisdiction. The authorization of the petitioner was suspended on the sole ground that 6A proceedings were initiated against the petitioner. Now the proceedings are stated to have been concluded.

In the circumstances, respondent Nos.3 and 4 are directed to take necessary action, in view of conclusion of 6A proceedings against the petitioner, within a period of thirty days from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
