THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11057 OF 2015 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/accused seeking bail in S.C.No.14 of 2014 on the file of the I Additional Sessions Judge, Rajahmundry, East Godavari District, registered for the offence under Section 8(c) read with Section 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act).

Heard and perused.

The allegation against the petitioner/accused is that he along with the other accused was found in possession of 120 kgs of ganja. Earlier bail application was dismissed by the Court below as well as this Court on the ground that he was absconding, but also on the ground that the contraband seized is of the commercial quantity. This Court, by way of interim order, dated 04.11.2015, granted interim bail till 29.11.2015, and directed the petitioner to surrender before the Magistrate concerned on 30.11.2015. The petitioner failed to surrender before the Court below as directed by this Court. Hence, this Court is not inclined to grant bail to the petitioner herein. The Criminal Petition is accordingly dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 07.01.2016 pln
