Mir Afsar Ali, v. The State Of Telangana,
HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.385 of 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the inaction of the respondents in considering the representation of the petitioner seeking to correct the online entries in revenue records in respect of agricultural lands in survey Nos.337/3CB, 834-3C-C and 402 of Oppicherla Village, Karempudi Mandal, Guntur District, as illegal and arbitrary.
Heard learned counsel for the petitioner and Assistant Government Pleader for Revenue. With their consent, the writ petition is disposed of at the admission stage itself. The limited grievance of the petitioner in this writ petition is that though the petitioner submitted a representation on 24.10.2016 to the 2nd respondent-Revenue Divisional Officer seeking correction of online entries, till date no steps are taken by the 3rd respondent, inspite of the endorsement of the second respondent dated 24.10.2016 directing the 3rd respondent to examine the same. Aggrieved over the same, the present writ petition is filed.
Learned AGP would submit that a suitable direction may be given to the 3rd respondent to consider the representation of the petitioner, if not already considered, in accordance with law. Having regard to the rival submissions made, the Writ Petition is disposed of directing the 3rd respondent-Tahasildar to consider the representation made by the petitioner on 24.10.2016,
which was forwarded to him by the 2nd respondent, if not already considered, seeking to correct the online entries in respect of agricultural lands in survey No.337/3CB and 402 of Oppicherla Village, Karempudi Mandal, Guntur District, and pass orders thereon, in accordance with law, after hearing the petitioner and aggrieved persons, if any, as early as possible, preferably within a period of four weeks from the date of receipt of a copy of this order. Miscellaneous petitions pending in this petition, if any, shall stand closed. No order as to costs.
