THE HON'BLE SRI JUSTICE MUMMINENI SUDHEER KUMAR WRIT PETITION No.29806 of 2022 ORDER:

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 4. The writ petition is disposed of at the stage of admission.

2.

It is the case of the petitioner that, the father of the petitioner, during his lifetime, entered into an Exchange Deed with respondent No.4 on 16.05.1987 and in terms of the same, the father of the petitioner acquired land to an extent of Acs.2.37 guntas in Survey No.495/A (495A/A) by relinquishing the right over the land to an extent of Ac.0.24 guntas in Survey No.510 in favour of respondent No.4. According to learned counsel for the petitioner, the said Exchange Deed was acted upon by the parties as well as by the respondents and the same was updated in the name of the petitioner's father in the revenue records. It is submitted that after demise of the petitioner's father, the name of the petitioner is also updated in the revenue records and the same is continued as on date. However, the said entries are not updated in online Dharani Portal. Therefore, the petitioner submitted an online application bearing No.ROS022002818088, dated 22.10.2020, requesting to update the said extent of land in

the name of the petitioner. However, the said application is still pending consideration with the respondents. It is further submitted by learned counsel for the petitioner that respondent No.4, after conducting a detailed enquiry, submitted a report to respondent No.3 through his Letter No.B/6067/2020, dated 02.03.2020, recommending for recording the name of the petitioner as pattadar in respect of the subject land. But, so far, the respondents have not taken any action. Hence, learned counsel for the petitioner prays this Court to direct the respondents to consider the request of the petitioner for updating the said extent of land in the name of the petitioner. 3.

On the other hand, learned Assistant Government Pleader for Revenue submitted that the online application submitted by the petitioner dated 22.10.2020 is in respect of regularization of sadabainama and the petitioner is required to submit a fresh online application seeking updation of her name in the revenue records and for issuance of pattadar passbook in her name and if the petitioner makes such application through online Dharani Portal requesting for redressal of her grievance, the same would be considered by the respondents, in accordance with law. 4.

Taking into consideration the submissions made on either side, the writ petition is disposed of permitting the petitioner to

submit an online application under the appropriate module on Dharani Portal requesting for updation of the name of the petitioner in the revenue records and for issuance of new pattadar passbook in her name in respect of land admeasuring Acs.2.37 guntas in Survey No.495/A (495A/A) situated at Bommanapally Village, Chigurumamidi Mandal, Karimnagar District, and for consequential issuance of e-pattadar passbook in the name of the petitioner, within a period of two (2) weeks from the date of receipt of a copy of this order and on submission of such application, respondent No.2 shall consider the same by duly taking into consideration the report submitted by respondent No.4 vide his Letter No.B/6067/2020, dated 02.03.2020, and pass appropriate orders, in accordance with law, within period of eight (8) weeks from the date of submission of online application by the petitioner. Respondent No.2 is further directed to put all the persons interested on notice and then pass orders, as directed above.

Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
