This Appeal Suit is dismissed for default against respondents 1 to 4 on 19.10.2011.

Learned counsel appearing for the 4th respondent by filing memo dated 12.09.2005, submits that the 4th respondent died on 19.12.2004.

Though the Appeal is dismissed for default against respondents 1 to 4 on 19.10.2011, no steps were taken by the appellant for setting aside the same. When the Appeal is dismissed for default against respondents 1 to 4, no relief can be granted against 5th respondent.

That apart, though the matter underwent several adjournments on 20.01.2017, 27.01.2017, 10.03.2017, 24.03.2017, 02.06.2017 and 24.08.2017, there is no representation on behalf of the appellant. It shows that the appellant is not evincing any interest in prosecuting this Appeal.

In view of the same, this Appeal Suit is liable to be dismissed and accordingly dismissed. There shall be no order as to costs.
