Narender Reddy Thatikonda v. The State Of Telangana
THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.8193 & 8188 of 2023 ORDER:
1.
These Criminal Petitions are filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.1 and 3 to 5 seeking bail in the event of their arrest in connection with Crime No.137 of 2023 on the file of Shabad Police Station, Cyberabad, Ranga Reddy District, registered for the offences punishable under Sections 341 and 307 r/w.34 of Indian Penal Code. 2.
Since the petitioners in both the petitions are accused in the very same crime, both the petitions are heard together and disposed off by this common order.
3.
Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.
4.
It is alleged by the de-facto complainant in his complaint that on 09.07.2023 in the evening when the de-facto complainant and his friend were going on a scooty, these petitioners allegedly stopped them and caused injuries deliberately. It is further alleged that both the de-facto complainant and his friend were severely injured.
5.
On the basis of the complaint, the Police registered Crime No.137 of 2023.
6.
Learned counsel appearing for the petitioners would submit that a false complaint was lodged subsequent to one Shashikala filing a complaint against de-facto complainant and others on 07.07.2023 alleging that they have attacked Shashikala and these petitioners supported her. 7.
Keeping in view that there are disputes between the parties and injuries received are simple in nature, this Court deems it appropriate to grant the relief of anticipatory to the petitioners, subject to the following conditions:
1) The petitioners/Accused Nos.1 and 3 to 5 is directed to surrender before the Station House Officer, Shabad Police Station, Cyberabad, on 06.09.2023. On such surrender, the said Station House Officer shall release the petitioners on bail, on their executing personal bonds for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to his satisfaction.
2) On such release, petitioners/Accused Nos.1 and 3 to 5 shall appear before the concerned Station House Officer at 10.00 A.M on every Monday and Wednesday for a period of eight weeks, for the
purpose of investigation and thereafter, as and when required.
3) The petitioners/Accused Nos.1 and 3 to 5 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.
8.
Accordingly, these Criminal Petitions are allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
