HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35618 of 2016 ORDER:

This writ petition is filed seeking to declare the registration of F.I.R.No.66 of 2016, dated 21.07.2016, by the 2nd respondent as illegal and arbitrary and consequently set aside the same. Heard and perused the material available on record. The main grievance of the petitioners is that the 2nd respondent registered F.I.R.No.66 of 2016, dated 21.07.2016, against the petitioners basing on a report given by the 3rd respondent for the alleged offence under Section 3(1) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, alleging that on 15.07.2016 at 7.

30 hours at Ramapuram Village, Balayapalli Mandal, the petitioners, who belong to upper caste of Ramapuram Village, Balayapalli Mandal deny a group of members who belong to Arundalemi Caste of the same village to provide service and necessary amenities to them on the issue of Chelaramma Godess Jathara dispute in the village. Considering the grievance of the petitioners, the 2nd respondent is directed to complete the investigation in F.I.R.No.66 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. The petitioners are directed to appear before the 2nd respondent as and when required for the purpose of investigation. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed.
