THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.22862 of 2019 ORDER:

This writ petition is filed seeking to transfer Crime No.91 of 2019 registered under Section 174 of the Code of Criminal Procedure, 1973, on the file of the Pahadisharief Police Station, Rachakonda, to any other police station for re-investigation.

Heard Sri Ponnam Ashok Goud, learned counsel representing Sri Venkat Goundla, learned counsel for the petitioner, and the learned Assistant Government Pleader for Home appearing for the respondents. Learned Assistant Government Pleader for Home would submit that after due investigation in Crime No.91 of 2019, a final report was filed under Section 173 Cr.P.C. to the effect that the case may be treated as 'accidental death due to self injury'.

Though the learned counsel for the petitioner disputes the said fact, as the final report had already been filed by the police authorities before the competent authority, it is for the petitioner to avail appropriate remedies in accordance with law.

The writ petition is disposed of, granting liberty to the petitioner to avail the appropriate remedies available to her under the Code of Criminal Procedure, 1973.

Pending Miscellaneous Petitions shall stand closed in the light of this final order. No order as to costs.
