THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.19799 of 2018 ORDER:

Heard learned counsel for the petitioners and Sri L.Venkateswara Rao, learned Standing Counsel for GHMC.

The inaction on the part of the respondent Nos.2 and 3, in taking action against the illegal constructions, said to have been made by the fourth respondent herein, in premises bearing No.8-4-549/86, Netajinagar, Opp.Viquarunissa Majid Erragadda, Hyderabad, is under challenge in the present Writ Petition.

The information available before this Court discloses that, on the representation made by both the petitioners herein on 19.04.2018, the GHMC, vide Lr.No.1351/TPS/ C19/GHMC/2018, dated 01.05.2018, informed that the owner of house bearing No.8-4-549/86, Netajinagar, Opp.Viquarunissa Majid Erragadda, Hyderabad did not obtain any permission from the GHMC and action will be initiated on the unauthorized constructions as per the Greater Hyderabad Municipal Corporation Act, 1955. It is submitted by the learned counsel for the petitioners that, despite the same, the respondent authorities are not taking any action.

Having regard to the above facts and circumstances of the case, this Court deems it appropriate to dispose the Writ Petition, with a direction to the respondent Nos.2 and 3 to

take action against the illegal constructions, pursuant to the Lr.No.1351/TPS/C19/GHMC/2018, dated 01.05.2018, as expeditiously as possible, in accordance with law. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions pending, if any, in this Writ Petition, shall stand closed. __________________ A.V.SESHA SAI,J 25th June, 2018 Tsy
