The learned counsel for the appellants submits that this appeal, which is filed assailing the order dated 08.04.2008 passed in IA.No.223 of 2007 in OS.No.67 of 2007 on the file of the Court of the Senior Civil Judge, Gudur, has become infructuous in the light of the fact that the suit has already been disposed of. Recording the said submission, the Civil Miscellaneous Appeal is dismissed as infructuous, as the cause in the appeal no longer survives. There shall be no order as to costs.
