This writ petition is filed for a Writ of Mandamus declaring the action of the respondents in not removing the illegal construction made over the premises bearing H.No.3-7-62/465, situated at Mansoorabad, L.B.Nagar, Hyderabad and the ramp laid by the respondent No.3 encroaching the public road, as illegal and arbitrary and for a consequential direction to the official respondents to consider the representation dated 07.02.2015 and take appropriate action in accordance with law. The case of the petitioner is that he is the resident of Plot No.466, Mansoorabad, L.B.Nagar, Hyderabad. While so, the unofficial respondent, who is the neighbour of the petitioner raised construction in his premises bearing H.No.3-7-62/465 in violation of rules and regulations of the HMC Act.
It is further submitted that the unofficial respondent has encroached the public road by laying the ramp in front of the petitioner's house, which is causing inconvenience to the petitioner as well as the colony members. As such, the petitioner gave a written complaint against the unofficial respondent on 07.02.2015 to the respondents. But no action has been taken by the respondents so far. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioner and Smt. A Deepthi, learned Standing counsel for respondents 1 and 2. Learned Standing counsel for respondents 1 and 2 submits that in pursuant to the complaint made by the petitioner, inspection has been done and found that the unofficial respondent has constructed a ramp on the public road.
action will be initiated basing on the inspection report. Since it is stated by the learned Standing counsel for respondents 1 and 2 that inspection has already been done, the 2nd respondent is directed to initiate action against the unofficial respondent basing on the inspection report, within a period of four
(4) weeks from the date of receipt of copy of this order in accordance with law.
