THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4253 OF 2016 ORDER:
This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 by the petitioner/A-1 seeking to quash the proceedings in Crime No.598 of 2015 of Shadnagar Police Station, Mahabubnagar District.
2. Heard and perused the material available on record.
3. The offences alleged against the petitioner are punishable under Sections 120-B, 420, 467, 468, 471, 323, 504 and 506 read with 34 I.P.C.
4. Case of the prosecution, in brief, is that the complainant is the absolute owner of lands to an extent of Ac.10.02 guntas situated at Burgula Village, Farooqgar Mandal and he purchased the said lands from one Bhavani Prasad Hajari through a registered sale deed, dated 17.6.1998, for valid consideration. The complainant went to U.S.A on 15.7.1999 and the petitioner/A-1, who is the close friend of the complainant, assured that he will take care of the properties of the complainant. But taking advantage of the absence of the complainant, the petitioner had conspired with his friends and got created a General Power of Attorney alleged to have executed by the complainant in his favour at Sub-Registrar, Nampally, Hyderabad vide document dated 9.3.2002. A-2 and A-3 attested the said document. Basing on the said G.P.A.
, the petitioner had executed a sale deed, dated 11.3.2002, in favour of A-4 and thereafter, A-4 had executed a registered sale deed vide document, dated 8.9.2003, in favour of A-5. On 10.11.2015, the complainant came to India and came to know about the fraud played by the accused. Then, he filed a private complaint before the Judicial Magistrate of First Class, Shadnagar.

5. Considering the facts and circumstances of the case, the police concerned are directed to complete the investigation and file a final report, if any, without arresting the petitioner. Further, the petitioner is directed to appear before the police concerned on or before 18.4.2016 and execute a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum for his future appearance. The petitioner is also directed to cooperate with the police.
6. With the above directions, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
