THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 22884 of 2019 ORDER:

This Writ Petition is filed for the following relief: "....to issue a Writ of Mandamus or any other appropriate Writ or Writs order or direction declaring the proceedings dated 06 09 2019 in File No 3/C1/15228/2019 on the file of the 2nd Respondent as illegal, arbitrary and without jurisdiction and to consequently direct the 2nd respondent to forthwith receive the application of the petitioner for grant of building permission in respect of his Plot bearing No.237/W in Survey No.159, 161 to 169, admeasuring 153.3 square yards, situated at Weavers' Colony, Bhavana Nagar, Kapra Village and Mandal, Ranga Reddy District, and grant building permission forthwith."

When the matter is taken up, it is submitted by the learned counsel for the petitioner that the issue raised in the present Writ Petition is squarely covered by the order dated 19.04.2016 passed by this Court in Writ Petition No. 37810 of 2015. Learned Standing Counsel for Greater Hyderabad Municipal Corporation appearing for the respondents does not dispute the aforesaid submission.

Relevant portion of the aforesaid order reads as under: "The writ petition is accordingly allowed setting aside the impugned proceedings dated 13.03.2014. The Greater Hyderabad Municipal Corporation shall reconsider the building permission application of the petitioner on its own merits and in accordance with the Greater Hyderabad Municipal Corporation Act, 1955, and the rules and regulations framed thereunder."

CKR, J W.P.No.22884 of 2019 In those circumstances, following the above said order and for the reasons recorded therein, this Writ Petition is also allowed in terms thereof.

Miscellaneous Petitions, if any pending, shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J 21st OCTOBER, 2019.
