THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CIVIL REVISION PETITON No. 3302 OF 2018 O R D E R :

Though the Revision is filed by the respondent - husband in MOP No. 2 of 2017 on the file of the Senior Civil Judge's Court at Allagadda, purportedly, questioning the innocuous order dated 28.04.2018 in I.A. No. 285 of 2018, whereunder P.W.1 was sought to be recalled for cross-examination, a perusal of the said order discloses that it was passed permitting to cross-examine P.W.1 on 01.05.2018. The petitioner, however, instead of cross-examining P.W.1 on the date so fixed, had rushed to this Court and obtained an order to stay all further proceedings in the M.O.P. Learned counsel for the petitioner submits that if an opportunity is given, the petitioner will cross-examine P.W.1 on the next date of hearing. Across the Bar, it is informed by the learned counsel that the M.O.P. is scheduled for 05.11.2018.

Learned counsel for the respondent also submits that P.W.1 will be present on the said date to enable the petitioner to crossexamine her. Recording the respective submissions, the Civil Revision Petition is disposed of directing the learned Senior Civil Judge at Allagadda to permit the petitioner's counsel to cross-examine P.W.1 on the next date of hearing i.e. 05.11.2018. No costs. Registry to despatch a copy of this order to the learned Senior Civil Judge, forthwith.

Consequently, the miscellaneous Applications, if any shall stand closed.
