THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13997 OF 2015 ORDER:

This criminal Petition is filed by the petitioner - Accused under Section 438 Cr.P.C., seeking to grant anticipatory bail in Crime No.41 of 2015 on the file of Kalakonda Police Station, Chittoor District, registered for the offences punishable under Section 323, 506 IPC and 3 (1) (x) of the SC & ST (Prevention of Atrocities) Act.

Heard and perused the material available on record. s The allegation against the petitioner is that while the petitioner taking photographs of the agricultural land of the de facto complainant, the de facto complainant objected for the same, for which the petitioner abused the de facto complainant in the name of his caste, and beat him with hands and legs.

Learned counsel for the petitioner submitted that the petitioner never committed the offences alleged against him and due to political rivalry, he was implicated in the case.

Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner. However, the petitioner is directed to surrender before the Magistrate concerned and file an application for grant of bail and the learned Magistrate is directed to consider the said application on the same day.
