THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.9616 of 2004 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India, seeking a writ of certiorari and call for the records on the file of the 2nd respondent in his office order No.E4/255(3)/2004-DY.CPM 'C' dated 17.05.2004 and quash the same as arbitrary, unjust and in violation of Articles 14, 16 and 21 of the Constitution of India and consequently direct the respondent to continue the petitioner as caretaker and pass such other orders.

2 When the matter is taken up for hearing, the learned counsel for both petitioner and the respondents, in one voice, submitted that the petitioner retired from service after attaining the age of superannuation and hence no further orders need be passed in this Writ Petition. 3 In view of the submissions made by the learned counsel for both parties, the Writ Petition is closed. No order as to costs. As a sequel, the miscellaneous petitions, pending in this Writ Petition, if any, shall stand closed.
