THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.2820 of 2016 ORDER:

Petitioner states that he was given D-Form patta vide proceedings No.21/10/71, dated 05.01.1971 and his name was entered in the pattadar and possessor column of the revenue record. Owing to his ill-health due to massive heart attack, he asked his elder son respondent No.5 to look after the lands. After his recovery, he found that bogus D-Form patta is issued in the name of his elder son respondent No.5 and entries came to be made in the revenue record in his name and that in spite of representations of the petitioner, no action has been taken by respondents 2 to 4.

The petitioner's complaint before the second respondent - District Collector, Kurnool is stated to have been acknowledged on 05.10.2015 vide application No.201513-3551913. It appears that the District Collector called for a report from the Revenue Divisional Officer and the matter is now pending before the Revenue Divisional Officer. Hence, it is appropriate to direct respondents 2 and 3 to obtain report and take appropriate action expeditiously. However, the authority which takes the decision in the matter shall do so only after notice to the petitioner and respondent No.5.

The Writ Petition is accordingly disposed of. Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed. No order as to costs.
