THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.6080 OF 2018 ORDER:

This petition is filed under Section 438 Cr.P.C. to grant anticipatory bail to the petitioner-A1 in Cr.No.860 of 2017 on the file of the Station House Officer, Neredmet Police Station, Rachakonda District, registered for the offences punishable under Sections 498-A, 354-A and 406 IPC and 3 and 4 of Dowry Prohibition Act.

Heard learned counsel for the petitioner-A1, learned Additional Public Prosecutor representing the State and perused the record.

The de facto complainant is the wife of the petitioner-A1. She alleged in her report, dated 19.12.2017, lodged with the Station House Officer concerned that the petitioner-A1 at the instance of other accused started harassing her both physically and mentally for additional dowry. Further, the petitioner-A1 demanded the de facto complainant to transfer the property in his name. The petitioner-A1 has also taken away the gold and silver articles belonging to the de facto complainant. The petitioner-A1 has also drawn amounts from her account. There are other allegations against the petitionerA1. Recently, the petitioner-A1 went to Australia. The de facto complainant begot two daughters. The allegations are grave and investigation is in progress. It cannot be said that the petitioner-A1 is an innocent person and falsely implicated in this case. Therefore, the petitioner-A1 is not entitled for anticipatory bail under Section 438 Cr.P.C.
