HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 21337 of 2016 ORDER:

Heard learned counsel for the petitioner, Government Pleader for Municipal Administration and Urban Development, Government Pleader for Respondent No.2, Sri S.Lakshminarayana Reddy, Learned Standing Counsel for respondent Nos.3 and 4 and Sri P.Jagadeeshchandra Prasad, learned Standing Counsel for respondent No.5. With the consent of all the parties, the writ petition is taken up for disposal at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents 3 to 5 in laying the road in the land admeasuring Ac.2.82 cents in Sy.No.212 of Revellapalem Village, H/o.

Madhurawada, Visakhapatnam, belonging to the petitioner's family, without following due process of law, as illegal, arbitrary and unconstitutional; and consequently direct the respondents not to interfere with the possession of the petitioner over the said property.

The grievance of the petitioner appears to be that without following due process of law, the respondents are trying to lay a road in his land.

The learned Standing Counsel for respondent Nos.3 and 4 submits that as on today no road is being laid through the land of the petitioner and if any road is laid, the same will be done after following due process of law.

Having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing the respondents to follow due process of law while laying the road in the land which is subject matter of dispute in the present writ petition. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
