Heard learned counsel for the petitioner and also learned Government Pleader for Home representing respondents 1 to 3 and perused the prayer in the writ petition with the supporting affidavit saying that, without even registering any crime, the police are harassing the petitioner.
The learned Government Pleader for Home submits that Crime No.251 of 2017 dated 31.08.2017 was registered by P.S.Anlova, Visakhapatnam District for the offences punishable under Sections 193, 426, 465, 467, 468, 471, 420, 120-B read with Section 34 I.P.C and Sections 3 and 4 of A.P. Land Grabbing Act from the report of one Mr.Alan Chong Teron.
Having regard to the above, the writ petition is disposed of leaving it open to the petitioner to pursue the available remedies in the Crime concerned according to law. Needles to say none of the offences are punishable above seven years and thereby, the police are bound to follow Section 41-A Cr.P.C. and the guidelines of the Apex Court in Arnesh Kumar Vs. State of Bihar1.
