THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.42722 OF 2016 ORDER:

Heard learned counsel for the petitioners, learned Government Pleader for respondents 1 and 2 and learned counsel appearing for third respondent.

This writ petition is filed challenging the registration of F.I.R.No.264 of 2014 by the second respondent on the complaint made by the third respondent.

The third respondent lodged a detailed complaint with the second respondent and a reading of the said complaint discloses prima facie case of involvement of the bank officers in the crime. The learned counsel appearing for the third respondent also submits that there were two vigilance reports of the Bank disclosing commission of offence by the officers of the Bank. This clearly shows that there is prima facie case for going ahead with the investigation of the crime. Learned counsel for the petitioner submits that on the complaint of the Chief Manager, F.I.R.No.367 of 2014 was registered on 13.10.2014 and the said complaint is not being investigated, whereas the present complaint registered at the instance of the third respondent alone is being investigated.

Learned Government Pleader submits that the said F.I.R.No.367 of 2014 and the present complaint, i.e., F.I.R.No.264 of 2014, were transferred to Crime Investigation Department (C.I.D), Warangal for investigation in view of the magnitude of the case. In view of the submission made by the learned Government Pleader that the case is under investigation, this Court is not inclined to interfere with the process of the investigation. However, this Court directs

the Investigating Officer concerned to conduct investigation in accordance with law.

At this stage, learned counsel for the petitioner submits that the investigation is being delayed and early completion of the investigation is desired. As seen from the above averments, the crime is registered in the year 2014 and three years have already elapsed. In view of the same, the Investigating Officer concerned shall complete the investigation as expeditiously as possible and file charge sheet/final report before the competent Court.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions pending, if any, shall also stand disposed of. __________________________ A.RAMALINGESWARA RAO, J 22.03.2017 pln
